Alliance Inspection Management (AiM) Consumer Website terms of use.

This document establishes the terms of use for Alliance Inspection Management (AiM) website and outlines services provided by AiM in the area of new and used vehicle inspections.  By using this site, you agree to be bound by these terms of use, including the binding arbitration provisions described in section 3, and you confirm that you are a legal adult age 18 or older.  If you do not agree to these terms of use or are under the adult age of 18, you are not authorized to use this site in any manner.

1. Description of site:  “Site” refers to this website, including all of its content and policies.  AiM may change the Site, including these General Conditions of Services, at any time at is sole discretion and without prior notice.  All changes posted to the Site are effective immediately. 

2. Services Offered.

 Description.  AiM provides vehicle inspection reports as requested by clients.  AiM does not charge fees for access to the Site but may charge fees for use of AiM products and/or services made available through the Site.  The purchase of any such products and/or services shall be subject to a separate agreement between the client and AiM or between the client and any third party contacted through the Site.  In the event of a conflict between any of the terms and/or provisions of these General Conditions of Services and any Separate Agreement, the terms and provisions of the Separate Agreement shall control.  AiM is not a party to any Separate Agreement that the client may enter into with a Third Party.

 Any listings of Third Parties on the Site, and/or the user’s ability to “click through” to another website from the Site, and/or the forwarding of any self-reported information that you provide to the Site to a Third Party, does not constitute a referral or recommendation by AiM.  You use the information as well as the products and/or services provided by the Site and/or any Third Party at your own free will.  AiM does not recommend, advise, or prefer that you use any particular Third Party.  Any Third Party that contacts you is solely responsible for its products and/or services and you agree that AiM shall not be liable for any damages or costs of any type resulting from your use or purchase of any Third Party’s products and/or services. 
 
3. Arbitration:  Site users and AiM each consent to binding arbitration should a dispute, disagreement or claim arise from use of the Site or from product and/or services offered therein.  Client expressly waives any right to arbitrate a dispute as a class action and the right to a jury trial.  Client and AiM will agree upon an arbitrator and its applicable rules from the American Arbitration Assocation, 725 South Figueroa, Suite 2400, Los Angeles, CA 90017. The arbitration hearing will be conducted in Los Angeles, CA.  If Client fails to select an arbitration organization within 30 days after notice from AiM, AiM may select the organization.  The arbitrator’s award is final and binding on all parties.

4. Disclaimer:  Aimdealerinspections.com does not make any representation or expressed/ implied warranties regarding its service, or in consideration of the vehicle’s design, compliance with any manufacturer specifications, operation, mechanical condition or safety of any vehicle inspected or any components parts.

5. Liability:  In the event  that aimdealerinspections.com cannot perform the inspection for whatever reason, aimdealerinspections.com sole liability shall be limited to the refund of the fee.   In no event will the liability of Aimdealerinspections.com and its employees, officers, directors, partners, agents and affiliates exceed the amount of the fees paid by you to Aimmobileinspections.com.  

6. Under no circumstances, shall Aimdealerinspections.com, its parent or affiliated companies, or any of their respective
employees, directors, officers, agents, vendors, or suppliers shall be responsible for any direct or indirect losses or damages arising out of or in connection with the use or inability to use the website and/ or the content, including without limitation, your reliance on any information or data points.
